The Gambia’s Supreme Court has rejected Ya Kumba Jaiteh’s restraining order to prevent nominated National Assembly Member Foday Gassama from taking oath of office.
The five panel court headed by Chief Justice Hassan Abubacarr Jallow today ruled that Mr. Gassama should be sworn in as a nominated lawmaker pending the outcome of Ya Kumba Jaiteh’s civil suit questioning the constitutionality of the revocation of her (Kumba’s) nomination by President Adama Barrow. The ruling goes against Mrs. Jaiteh’s application that Gassama’s swearing in must wait until judgment is ordered.
The court dismissed Mrs. Jaiteh’s application for “want of merit,” with Justice Jallow warned the embattled Jaiteh not to interfere in the swearing in of Gassama.
Mr. Gassama, a former United Democratic Party West Coast Coordinator, is expected to take oath of office on Monday March 18.
The Supreme Court had earlier restrained the Attorney General, Speaker and Clerk of Parliament from swearing Foday Gassama until the case is decided.
